Road Traffic Accidents involving Passengers

Some things to know:

  1. If you have been a passenger injured in a car accident, you may be entitled to compensation.
  2. You have two years to bring your claim. Because of the time limits in personal injury cases, you should seek legal advice as soon as possible.
  3. You can still bring a claim if you have been in a collision with an unidentified or uninsured driver;
  4. You can make a claim for compensation even if you were not wearing your seatbelt or you were drunk or some other similar reason.
  5. If you have been injured, you should seek medical attention as soon as possible.
  6. If you are a passenger on a bus which crashes you can bring a claim.Even if you don’t know or are not sure of the third party details, you should speak to your solicitor as soon as you can.
  7. Your solicitors will most likely be able to clarify these issues.
  8. In order to commence your case, your solicitor will see a medical report from your treating doctor and then submit your claim to the Personal Injuries Assessment Board (PIAB).
  9. If you have had prior injuries, claims or the accident has exacerbated existing medical conditions, you can still bring a claim and should immediately speak to your solicitor.
  10. It is a good idea to take photographs of the vehicles and the damage at the scene of the accident and perhaps take a note of what was said and what you remember about how the accident occurred.
